Job Description:
Nesco Engineering and IT is currently seeking a Contracts
Specialist for a Contract opportunity in Tucson, AZ. The Contract
Specialist reports to the Export Control and Contract Compliance
Manager. The Contract Specialist is responsible for the ongoing
management of all in-house government and commercial contracts and
agreements and ensures that the Company is compliant on all terms
and conditions. The Contract Specialist interacts with people in
all levels of the organization, as well as individuals outside the
organization, therefore excellent interpersonal and communication
skills, both written and verbal, are required. The position
requires an individual with strong organizational skills who is
accurate, timely, and detail-oriented with the ability to work
under pressure and follow-through tasks with minimal supervision.
Primary Responsibilities:
- Manage non-technical terms and conditions.
- Draft and negotiate Non-Disclosure Agreements (NDAs),
Proprietary Information Agreements (PIAs) and other contractual
documents.
- Negotiate contractual terms and conditions with minimal
assistance.
- Maintain accurate electronic files for contractual
documents.
- Develop and maintain a current Federal Acquisition Regulation
(FAR) / Defense Federal Acquisition Regulation Supplement (DFARS)
internal reference database.
- Manage System for Award Management (SAM) and other Government
portals, as required.
- Conduct and document customer credit analysis.
- Provide internal training on contractual matters.
- Document and maintain vendor Cybersecurity certifications
required by the National Institute of Standards and Technology
(NIST), FAR, DFAR and other applicable regulations.
- Provide contractual review and input Quotations.
- Cross-Train within Contract Department to proficiency, and
within other departments as required.
- Other duties as assigned. Experience and Education
Requirements:
- Bachelor's degree in a business discipline, or equivalent
experience.
- Minimum five years' experience in Government and Commercial
contract administration.
- Working knowledge of FAR, DFAR and Uniform Commercial Code
(UCC).
- Experience with US Government and other customer web portals
desirable, including the Procurement Integrated Enterprise
Environment (PIEE) and Wide Area Workflow (WAWF).
- Experience in the administration of federal government
contracts, subcontracts, and commercial contracts.
- Government and Commercial proposal preparation and analysis of
terms and conditions.
- Contract Negotiation, to include contract Terms and Conditions,
NDA's, Purchase Orders, and other agreements as required.
- Candidate must be articulate, demonstrate excellent
communication, negotiation, and organizational skills. Must be
comfortable and confident in dealing directly with all levels of
internal and external customers.
- The successful candidate must possess a demonstrated ability to
deal with project deadlines.
- Candidate must be self-motivated, resourceful, and organized,
taking ownership of all assigned work.
- Must be able to satisfy federal government requirements for
access to government information.
- National Contract Management Association (NCMA) certification a
plus
- Highly proficient computer skills
- Microsoft 365 Office suite
- Enterprise Resource Planning System (ERP) Specific Tasks and
Focus Areas:
- Manage non-technical terms and conditions.
- Attend internal meetings, as required, to review contract terms
and conditions
- Review new orders prior to acceptance for appropriate and
acceptable FAR and DFAR clauses
- Identify contractual issues and proactively recommend
solutions
- Review all non-technical contract terms and conditions on
incoming contracts and vendor purchase orders
- Perform ongoing review of Company's standard Terms and
Conditions and revise to adhere to current US Government
regulations and policies
- Perform annual review of customer negotiated Terms and
Conditions
- Participate in the drafting and negotiation of various
agreements
- Manage contract compliance of all non-technical terms and
conditions
- Maintain record retention of all executed documents
- Completion of business surveys and certifications
- Completion of customer requests for Company's representations
and certifications
- Communicate directly with the customer on issues related to
contract terms and conditions
- Track, prepare, and submit customer pro-forma invoices and
provide internal notification of receipt of payment
- Note special invoicing requirements, as necessary, to incoming
orders
- Other miscellaneous contract related tasks, as required
- Draft and negotiate NDAs, PIAs and other contractual
documents.
- Negotiate contractual terms and conditions with minimal
assistance.
- Maintain accurate electronic files for contractual
documents.
- Develop and maintain a current Federal Acquisition Regulation
(FAR) / Defense Federal Acquisition Regulation Supplement (DFARS)
internal reference database.
- Review financial, government (FAR, DFARS) and industry terms
and conditions for applicability
- Create and maintain a searchable FAR / DFARS database
identifying use and acceptability of clauses
- Manage System for Award Management (SAM) and other Government
portals, as required.
- Maintain access to and provide entry of updated information in
US Government and customer portals.
- Conduct and document customer credit analysis
- Review customer payment terms
- Document risk management decisions on low sales volume
customers requesting negotiated terms and conditions
- Provide internal training on contractual matters
- Identify opportunities to train stakeholders
- Provide internal training relating to US Government and
Commercial contract topics
- Develop training process models, as required, to document
Contract Specialist functions
- Provide cross-training for employees for specific Contract
Specialist functions
- Document and maintain vendor Cybersecurity certifications
required by the National Institute of Standards and Technology
(NIST), FAR, DFAR and other applicable regulations.
- Continuously monitor Cybersecurity Maturity Model Certification
(CMMC) industry requirements and publish internal notification of
compliance changes
- Develop action plans for ongoing CMMC vendor compliance
- Provide contractual review and input into Quotations
- Assist sales department with development of Terms & Conditions
statements, and special conditions on Quotations
- Assist sales department in adherence to quoted terms and
conditions on customer Purchase Orders prior to acceptance
- Cross-Train within Contract Department to proficiency, and
within other departments, as required.
- Develop cross-training documentation for Contract Specialist
duties. Train other employees as requested
- Cross-Train to learn job duties of other positions to provide
internal support when necessary
- Other duties as assigned.
- Actively participate on special programs, projects, and
committees, as requested
- When necessary, provide back-up to other CHAMPS employees.
